OAKLAND 29 April 2026 (The Capital Post) – Billionaire Elon Musk has taken a strong stance against OpenAI, accusing the artificial intelligence company and its leadership of abandoning its original nonprofit mission during a closely watched court trial in California.
Musk, who testified as the first witness in the case, argued that OpenAI’s founders misused the organisation’s charitable foundation by transforming it into a profit-driven entity, a move he claims undermines public trust and the purpose of charitable institutions.
During proceedings, Musk insisted that the company’s shift toward commercialisation represented a fundamental betrayal of its original goals, stating that artificial intelligence should remain aligned with the public interest rather than private gain.
The lawsuit, filed by Musk, targets OpenAI chief executive Sam Altman, co-founder Greg Brockman, and major investor Microsoft, alleging that the organisation’s restructuring violated its founding principles and commitments.

Legal representatives for Musk argued that the original intent behind OpenAI’s creation was to develop artificial intelligence for the benefit of humanity, but that this vision was later compromised as the organisation pursued large-scale commercial funding and partnerships.
OpenAI, however, has rejected the allegations, maintaining that its structural changes were necessary to secure the massive investments required to develop advanced AI systems and remain competitive in the global technology race.
