MOH Respects Court Decision on Nicotine Gel and Liquid Exemption

KUALA LUMPUR, 17 May 2026 (The Capital Post)Malaysia’s Ministry of Health (MOH) has taken note of and respects the recent Kuala Lumpur High Court decision regarding the judicial review on procedural aspects linked to the exemption of nicotine liquid and gel from the Poisons List under the Poisons Act 1952.

According to the ministry, the court’s decision reflects a healthy system of checks and balances while demonstrating the strong concern shown by the public, civil society organisations (NGOs) and stakeholders towards public health protection policies.

MOH also stressed that both the ministry and NGOs share the same ultimate objective, which is to safeguard the safety and health of Malaysians.

Following the ruling, the ministry said further discussions will be held with the Attorney General’s Chambers (AGC) in the near future to refine legal aspects, review possible legal actions and determine the appropriate next steps.

In the same statement, MOH reaffirmed its commitment to strengthening tobacco and smoking product control efforts through continuous monitoring under Act 852 in order to protect public health, particularly among children and younger generations.

The ministry added that further developments and follow-up actions regarding the matter will be officially announced once consultations with the AGC have been finalised.
